Risk varies by role

Payment authority, privileged system access and confidential information create different exposures. Preventive checks should be linked to specific duties and legitimate needs rather than imposed uniformly across a workforce.

Proportionality comes first

A risk-based model does not authorise recurring indiscriminate checks or permanent monitoring. Every processing operation requires an appropriate legal basis, a clear purpose and a demonstration of necessity and proportionality.

Respect workplace privacy

Spain’s LOPDGDD provides specific safeguards for privacy and employer-provided digital devices. Employers must give appropriate information, restrict access and define retention periods. Employee-representation rights may also be relevant.

How AI can support controls

AI can organise role matrices, approvals, audit trails and process documentation. Its most defensible use is improving governance rather than silently generating invasive personal profiles or predictions of conduct.

Assess impact before deployment

Processing likely to create high risks for individuals may require a data protection impact assessment. Organisations should also review security, processors, international transfers and effective correction procedures before introducing new tools.
